Variances & Rezonings
A variance is needed whenever renovation or construction requires an exemption
from zoning ordinances. For example, let's say you want to add an addition
to your house. The zoning ordinance requires a 7 foot side yard setback,
meaning your structure must be no closer than 7 feet from your side yard
property line. However, you have a narrow lot and if you build your
structure as designed it will be approximately 5 feet from the side yard line.
In this case, you will need to obtain a variance. Get a
variance request form from
our documents section.A rezoning is required when you want to use a property
for a purpose for which it was not zoned. For example, you want to build a
duplex but the lot is zoned single-family or you want to build a retail unit and
the property is zoned R5 (single family or duplexes). Get a
rezoning application from
our documents section. The process is similar for variances and rezonings:
- Apply for a variance or rezoning,
- Obtain a hearing date for the Board of Zoning Adjustments (BZA).
- Inform the VP-Planning and the NPU Representative for the neighborhood.
- Present your variance request to the neighborhood organization at the
monthly meeting and ask for its approval.
- Present your variance request to the Neighborhood Planning Unit and ask
for its approval.
- Appear before the BZA.
Materials Needed at Neighborhood or NPU Meeting You will need to
bring
- letters or petition of support from all adjacent and line of site
neighbors, front and rear.
- Plans including plat, elevations, and layout.
- any other documentation that will bolster your case.
